1. Information on how to enter and prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

 

2.The promotion commences on Monday, 1 March 2010 and closes at 11.59pm AEST on Friday, 30 April 2010 (“Promotional Period”).

 

3.Offer is not valid in conjunction with any other offer. Entry is only open to Australian residents 18 years or over who purchase a selected Electrolux Bottom Mount Fridge (models detailed below) (“Participating Product”) from any participating retail store during the Promotional Period.

Participating Products are the following Electrolux Bottom Mount Fridge models:
EBM4300SC, EBE4300SC, EBM5100SC, EBE5100SC, EBM4307SC, EBM5107SC

 

4. The Promoter does not guarantee that all Participating Products will be available for purchase throughout the Promotional Period.

 

5.For the purposes of these Terms and Conditions, the following definition applies: 'Purchase' means payment in full for the Participating Product during the Promotional Period from an Australian participating authorised Electrolux dealer.

 

Purchase does not include:

(i) rental payment plans with a term of less than 18 months;
(ii) lay-buys or pre-orders not paid in full
(iii) Commercial or business transactions involving the purchase of more than three (3) units total of Participating Products;
(iv) purchases via eBay or similar online third party internet websites;
(v) second hand products or
(vi) purchases made in conjunction with any other offer.

 

6.Employees (and their immediate families) of the Promoter, participating retailers and agencies associated with this promotion are ineligible to enter. Promotion excludes all purchases made directly from Electrolux Home Products Pty Ltd.


7. To be eligible to enter the competition, entrants must visit www. electrolux.com.au/promotions, follow the prompts to the official entry form, complete the requested details including their first name, last name, delivery address, postal address, home phone number, mobile number, qualifying product model number, serial number, nominated email address, full purchase receipt number, purchase receipt date and store of purchase, and then accept the promotional terms and conditions. Entries must be received by 11.59pm AEST on Friday, 30 April 2010. No entries will be accepted after this date. If an entrant is unable to provide the serial number of the Participating Product purchased at the time of submitting the online entry form, the entry will be accepted for consideration, however the serial number must be received by the Promoter within 90 days of the date of purchase of the Participating Product and no later than 29/07/10.

 

8. Entries will be submitted into the Consumer Prize Draw. Entrants will be entered into a Consumer Prize Draw based on when their entry is received. Entries for each Consumer Prize Draw close at 11.59pm AEDST/AEST (depending on the date), on each day of the Promotional Period. Un-drawn entries in each Consumer Prize Draw will be entered into any subsequent Consumer Prize Draws.

 

9.The Consumer Prize Draws will be conducted on the following dates:

o Thursday, 25 March 2010 [for entries received during the period Monday, 1 March 2010 to Wednesday, 24 March 2010 (inclusive)];
o Wednesday, 14 April 2010 [for entries received during the period Thursday, 25 March 2010 to Tuesday, 13 April 2010 (inclusive)]; and
o Monday, 3 May 2010 [for entries received during the period Wednesday, 14 April 2010, to Friday, 30 April 2010 (inclusive)].

 

10.The first valid entry drawn in each Consumer Prize Draw will win a Redballoon Gift Voucher to the value of $1000 and redeemed at www.electrolux.redballoon.com.au in conjunction with the terms and conditions of issuance which can be found at http://www.redballoondays.com.au/help/terms-conditions.

 

11.Any ancillary costs associated with redeeming the Redballoon Gift Voucher are not included. Any unused balance of the Redballoon Gift Voucher will not be awarded as cash. Redemption of the Redballoon Gift Voucher is subject to any terms and conditions of the issuer including those specified on the Redballoon Gift Voucher.

 

12.There will be a total of sixty one (61) Consumer Prize Draws for this promotion. All Consumer Prize Draws will take place at The Consortium Centre, 87 Egerton Street, Silverwater NSW 2128 at 11am AEDST/AEST (depending on the date). The Promoter reserves the right to draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.

 

13.Winners will be notified by email within two (2) business days of the relevant draw date and their names will be published in The Australian on the dates specified below:

o Thursday, 1 April 2010 (for all Consumer Prize Draw winners drawn on Thursday, 25 March 2010);
o Wednesday, 21 April 2010 (for all Consumer Prize Draw winners drawn on Wednesday, 14 April 2010) and
o Monday, 10 May 2010 (for all Consumer Prize Draw winners drawn on Monday, 3 May 2010)


14.If any prize is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

 

15.Total prize pool value is up to $61,000.

 

16.Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

 

17.A draw for any unclaimed prizes may take place on Wednesday, 4 August 2010 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners’ names will be published in The Australian on Wednesday, 11 August 2010

.

18. The promotion excludes Participating Products purchased through any online discounter (including shoppingsafari.com.au, thebargainhunter.com.au, shopbot.com.au), online bidding or auction websites (including ebay.com.au) or otherwise purchased through unauthorised retailers.

 

19. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.


20. If an entrant has not received their purchased Item from their retailer, at time of payment entrants are still eligible for entry into the Consumer Prize Draw if they have paid in full within the Promotional Period. Orders showing incomplete payment for the participating products will not be accepted.

 

21. Incomplete, indecipherable or illegible claims will be deemed invalid.


22. Multiple entries permitted up to a maximum of three (3) entries, subject to the following: (a) only one (1) entry permitted per specified purchase requirement; and (b) each entry must be submitted separately and in accordance with claim requirements.


23. Entrants must retain the original purchase receipt(s) for all entries as proof of purchase. Failure to produce a copy of the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize.

 

24. Any cost associated with accessing the Promoter's website for the purpose of registering an entry is the entrant's responsibility and is dependent on the Internet service provider used.

 

25. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

 

26. The Promoter makes no guarantee of the availability of its web services and will not be held responsible for interruption of service that may interfere with the ability to participate in the Promotion.

 

27. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrant's or any other person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.

 

28. Caution: any attempt to deliberately damage the Promoter's promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these conditions of entry or any other legal obligation by an entrant, the entrant agrees to indemnify the promoter for those losses, damages and costs.

 

29. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.

 

30. Prize winners should allow 28 days for delivery of their Redballoon Gift Voucher from their Consumer Prize Draw date.


31.The Promoter reserves the right to reclaim the Redballoon Gift Voucher from any entrant, if the initially purchased Participating Product is returned after the entry has been processed and fulfilled (other than for warranty reasons). This clause does not limit or affect the entrant's rights with regards to warranties on the Participating Product either from the manufacturer or implied by legislation.

 

32. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion, subject to any written directions made under applicable State or Territory legislation.

 

33. It is the responsibility of the consumer to be available for the delivery as organised by the Promoter. In the case of an item being undeliverable, it is the responsibility of the consumer to organise the redelivery at their own cost.

 

34. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by an entrant; or (f) use of a prize.

 

35. Entrants consent to the Promoter using the entrant's name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products or services manufactured, distributed and/or supplied by the Promoter. The winners agree to participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.

 

36. All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion and opting in at the point of product registration, each entrant also acknowledges that a further primary purpose for collection of entrants' personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. The Promoter may share information with its Australian related companies and promotional partners who may contact entrants with special offers in this way. By entering the promotion and opting in at the point of product registration, each entrant agrees that the Promoter may use entrants' personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner's name and locality in any media as required under the relevant lottery legislation. 37.LAY-BY-CLAUSE Please note that only lay-bys that have been paid in full by Friday, 30 April 2010 are eligible for entry into the Consumer Prize Draw. PLEASE NOTE: Purchasers of EBM4300SC, EBE4300SC, EBM5100SC, EBE5100SC, EBM4307SC, EBM5107SC models for Government and Commercial contract sales, second quality (T2) and auction goods are excluded from this promotion. SECOND QUALITY GOODS (T2) If your appliance Serial Number has “T2” before it, you will not be entitled to claim.

2. To claim, claimants must visit www.electrolux.com.au/promotions, follow the prompts to the official claim form, input the requested details including their first name, last name, delivery address, postal address, home phone number, mobile number, Participating Product model number and serial number (if applicable), nominated email address, full purchase receipt number, purchase receipt date and store of purchase, and then accept the promotional Terms and Conditions. Online claims must be received no later than 11:59pm AEST on Friday, 14 May 2010. No claims will be accepted after this date.
